Four Women Health Services filed its lawsuit against Choose Life Marketing and Abundant Hope Pregnancy Resource Center, claiming that the marketing services provided by Choose Life Marketing for Abundant Hope mislead women seeking abortions by offering alternatives such as parenting support, adoption resources, and material assistance. The abortion facility alleges that these efforts interfere with its business interests under Massachusetts General Laws Chapter 93A, which prohibits unfair or deceptive acts in trade or commerce. In response, Thomas More Society attorneys filed a Motion to Dismiss on March 14, 2025, arguing that Choose Life Marketing should be removed as a defendant in the case. The motion demonstrates that the marketing agency’s activities—creating advertisements, managing websites, and promoting Abundant Hope’s charitable mission—are lawful, standard business practices that do not violate any statute. Moreover, the motion emphasizes that these actions are constitutionally protected speech under the First Amendment, as they express a pro-life viewpoint and provide truthful information about options available to pregnant women.
